Breaking News: U.S. Supreme Court Expedites Oral Arguments on Vaccine Mandates

Two of the vaccine mandates that are part of President Biden’s Pathway Out of the Pandemic plan will be heard by the U.S. Supreme Court on January 7. The mandate for all employers with 100 or more employees to enact vaccination and testing processes, and the rule that requires all health care workers at facilities that participate in the Medicare and Medicaid programs to be fully vaccinated against COVID-19 have been granted oral argument on a highly expedited schedule.
Last week a three-judge panel in the Sixth Circuit lifted the stay enacted by the Fifth Circuit with a 2-1 nod. The Biden Administration is lobbying to fully enforce the rules at this time, although they’ve pledged that they won’t begin issuing fines for non-compliance until January 10.
